GLoan Terms and Conditions

Welcome to GLoan.

The terms and conditions for GLoan (“Terms”) serve as a contract between you (“Borrower”) and Fuse Lending, Inc. (“Fuse”), a registered lending company under the Securities and Exchange Commission, for the GLoan that you have availed through the GCash App. The term “Loan,” as used in these Terms, refers to the loan amount that Fuse granted to you. Using the GLoan feature on the GCash App, you confirm that you have read, understood, and accept these Terms and the terms of the Disclosure Statement (collectively and for brevity, the “Agreement”) as defined below.

  • 1.APPLICATION AND VERIFICATION PROCESS

    • 1.1. You undertake to accomplish and submit the GLoan application form. You certify that the information you have provided in the GLoan application form is true and correct as of the date of application.
    • 1.2. You agree that in the event of any misinformation, misrepresentation, or failure on your part to disclose information required in the GLoan application may cause Fuse to (a) reject your GLoan application; (b) cancel its approval if already made; or (c) demand full payment of the Loan if already received, including the applicable interests and charges. Fuse shall not refund any processing fee you paid relating to the Loan application.
    • 1.3. You authorize Fuse to conduct verification to establish the accuracy and completeness of the information you have provided to Fuse. This includes verification with the following:
      1. a.) Fuse Group, which includes but not limited to (a) Fuse; (b) its affiliates and subsidiaries, including but not limited to Globe Telecom, Inc., Globe Fintech Innovations, Inc., and G-Xchange, Inc.; (c) Fuse’s business partners, service providers, and other third-party partners contracted by it to conduct its business operations (e.g. credit scoring partners and partner-collection agencies, etc.); and (d) their respective, officers, employees, agents, and representatives; and
      2. b.) Authorized Entities, which include (a) the Bureau of Internal Revenue; (b) any credit information bureau, banking, or credit industry association, credit information service provider, and credit/loan provider, including the Credit Information Corporation (“CIC”), Bankers Association of the Philippines, TransUnion Information Solutions Philippines, and Trusting Social Philippines, Inc.; and (c) other lenders as authorized by the CIC, and credit reporting agencies duly accredited by the CIC.
    • 1.4. For purposes of Republic Act No. 9510 or the Credit Information System Act and its implementing rules and regulations, the submission of your GLoan application serves as notice to Fuse that your credit data, as defined under said law and regulations, shall be disclosed to the extent reasonably necessary for Fuse Group to carry out its operations and discharge its functions and responsibilities for as long as you have an outstanding Loan and obligations with Fuse, or as necessary and required under existing laws, rules, and regulations.
    • 1.5. You consent and agree that Fuse Group may send you short messaging services (SMS), mobile, in-app messages, and/or email alerts/messages to confirm your GLoan application, verify other information in connection with such application, or for other purposes concerning it. Fuse has the right to (a) reject your GLoan application, (b) cancel any approval if already made, or (c) declare the Loan due and demandable in case the Loan has already been released, should you fail to reply to these messages and/or verify the information that require your confirmation within the prescribed period specified in the message. Fuse shall not refund any processing fee you paid for the Loan application.
    • 1.6. Fuse reserves the right to require periodic updates of your KYC information. You agree to provide the necessary information, when requested.
    • 1.7. Fuse reserves the right to reject or approve your GLoan application based on your repayment capacity as determined by Fuse and the result of Fuse’s verification process, credit investigation, or credit scoring.
    • 1.8. You shall release and hold Fuse free and harmless from any claims, demands, or liabilities of whatever kind or nature in connection with, or arising from, (a) the application and verification process, (b) disclosure of your information in connection with such application, (c) processing of your personal information (as defined below), (d) the Agreement, and (e) from any acts directly or indirectly related to the preceding, unless such claims, demands, or liabilities are due to fault solely attributable to Fuse.

  • 2.LOAN, FEES, AND CHARGES

    • 2.1. You will choose the Loan and Loan duration from the options that Fuse will provide you, subject to adjustments based on the result of Fuse’s verification process.
    • 2.2. You agree to be bound by and undertake to comply with the terms of the disclosure statement, which contains, among others, the following information (“Disclosure Statement”):
      1. a.) your personal information;
      2. b.) Loan duration;
      3. c.) Loan amount;
      4. d.) Charges and deductions (e.g. processing fee and applicable taxes);
      5. e.) Loan proceeds [Loan amount less charges and deductions];
      6. f.) Schedule of payment;
      7. g.) Interest rates;
      8. h.) Collateral, if any; and
      9. i.) Late payment fee
    • 2.3. You agree to pay the sum payable under the Disclosure Statement and other fees as may be imposed or mandated by government agencies relating to the Loan.
    • 2.4. You further agree that Fuse may adjust the details in the Disclosure Statement should changes be mandated by applicable laws, rules, and regulations or at Fuse’s sole discretion based on its policies. You agree that any adjustment shall be binding upon your receipt of a written notice from Fuse specifying these adjustments. In case you disagree with the adjustments, you have the option to fully pay the Loan, including applicable fees, interests, late payment fees, and other charges, within thirty (30) days from receipt of adjustment notice from Fuse.

  • 3.LOAN RELEASE

    • 3.1. The Loan proceeds shall be released to the GCash wallet of the account you used to apply for GLoan.
    • 3.2. You acknowledge that the Loan's proceeds or any part(s) thereof shall be deemed to have been received on the date the Loan proceeds are credited to your GCash account. If Fuse receives no complaint from you within three (3) business days from when the Loan proceeds were credited to your GCash wallet or if you use any portion of the disbursed Loan, then you are deemed to have received the full and correct Loan amount and have fully acknowledged and accepted all the details specified in the Disclosure Statement.
    • 3.3. Fuse reserves the right to cancel and recall the approved Loan if the Loan cannot be fully disbursed to your GCash wallet for whatever reason (e.g., your GCash wallet has reached the transactional wallet limit). If a portion of the Loan has been successfully disbursed to your GCash wallet, you shall pay the amount due, interest, and other charges applicable to the disbursed Loan under this Agreement.

  • 4.REPAYMENT

    • 4.1. You will receive a payment due reminder via GCash channels before the payment due date.
    • 4.2. Billing details will also be available on the GCash App which shows the billing period, principal amount, interest, fees, charges, previous balance, and the total billed amount.
    • 4.3. You shall repay the Loan, in accordance with the payment schedule set out in the Disclosure Statement, either by (a) voluntary payment via the GCash App, (b) automatic deduction of the amount due from your GCash wallet, or (c) through any of our partner bank or over-the-counter repayment channels. Nothing in this Agreement shall prohibit you from paying the Loan in advance.
    • 4.4. Should the total amount you paid exceed the amount due (“Excess Payment”), Fuse shall apply the excess amount to your next payment installment.
    • 4.5. You may prepay the total amount of the Loan before its maturity subject to a reasonable processing fee..
    • 4.6. You shall receive a confirmation via in-app notification or SMS if your payment has been successful.
    • 4.7. If there are no other amounts due from you, you may request the return of the Excess Payment by filing a ticket through GCash’s Help Center. Fuse will notify you in writing once Excess Payment has been credited to your GCash wallet.
    • 4.8. If you default in paying the Loan following the schedule specified in the Disclosure Statement, you agree that Fuse shall automatically deduct or set off any overdue amount once your GCash wallet is funded. Automatic deduction or set-off shall include delay charges as specified below.
    • 4.9. You agree to pay a late payment fee on any overdue amount at the rate specified in the Disclosure Statement (“Late Payment Fees”). Late payment fee shall be added on each unpaid installment from due date until fully paid.

  • 5.DEFAULT

    • 5.1. You acknowledge that the following cases constitute a Default:
      1. a.) Non-payment of any amount due and payable per the Disclosure Statement on the due date;
      2. b.) bankruptcy, insolvency, receivership, levy on execution, garnishment, or attachment, or in case that any litigation or proceedings similar to those enumerated previously are initiated by or against you affecting your repayment capacity or financial stability;
      3. c.) when any information you provided to Fuse is found to be spurious, fraudulent, misrepresented, inadequate, incomplete, or incorrect in any material detail;
      4. d.) your failure to comply with any of your material obligations under the Agreement; or
      5. e.) the occurrence of an event which, in Fuse’s opinion, affects your ability to perform your obligation under the Agreement.
    • 5.2. In case of a Default, the outstanding Loan and all applicable fees and charges shall immediately be due and demandable without prior demand and prejudice to other rights and remedies available to Fuse under the Agreement and applicable laws. You agree that Fuse may:
      1. a.) report such Default to Fuse Group and Authorize Entities and Borrower’s name will be included in the negative listings of Fuse Group and Authorized Entities; and/or
      2. b.) appoint or designate a representative, agent or attorney–in–fact, including third-party collection agency, to perform any and all acts which may be required or necessary to enforce its rights under the Agreement in connection with such Default. Fuse will notify you in advance if Fuse decides to refer your GLoan account to a collection agency.

  • 6.LIMITS OF LIABILITY

    • 6.1. Refund claims directed to Merchant
      Your acceptance of the Terms constitutes your agreement that neither Fuse nor any of its affiliates will be responsible for any loss or damage that you or any third party will incur as a result of:
      1. a.) iany incomplete, inaccurate, or incorrect information that you have provided to Fuse;
      2. b.) any fraud, bad faith, and misrepresentation on your part;
      3. c.) the effect of any changes in relevant laws to the Loan or the Agreement;
      4. d.) errors or malfunctions of the Fuse’s system or systems used or connected to Fuse by third parties; and
      5. e.) your failure to implement the necessary security measures to guard against fraud or identity theft.
    • 6.2. You release Fuse from any and all claims related to these Terms, including those for losses or expenses you incurred, unless such losses or expenses are directly attributable to Fuse’s gross negligence or willful misconduct. In no case shall Fuse’s total liability for direct damages resulting from its gross negligence or willful misconduct exceed the direct and actual amount. Fuse shall not be subject to any rights or claims from third parties and shall not be held liable for any damages caused by any act omission by a third party.

  • 7.CONSENT TO PROCESSING OF PERSONAL INFORMATION

    • 7.1. You understand, authorize, and consent to the Fuse Group and the Authorized Entities to collect, process, use, store, record, organize, and update your personal information necessary or incidental to your GLoan application. Your personal information, which categories are enumerated below, will be collected and processed for compliance with Know-Your-Customer (KYC) and anti-money laundering rules, credit investigation, credit scoring, debt collection, fraud investigation, product and systems development, data analytics, profiling, sales, and marketing activities and communications relating to Fuse Group’s products and/or services, and the continuous enhancement of customer experience in the GCash App:
      1. a.) Personal profile, such as name, age, birthdate, birthplace, nationality, physical address, email address, telephone number, marital status, and sex;
      2. b.) Emergency Contact name and contact information;
      3. c.) Credit information;
      4. d.) Credit score;
      5. e.) Data usage records;
      6. f.) Promo subscription and redemption records;
      7. g.) Voice calling data records;
      8. h.) SMS sending and receiving records;
      9. i.) Customer relationship management records (e.g. correspondences and photos);
      10. j.) Pre-paid load balance, top-up, and usage records;
      11. k.) Value-added service records;
      12. l.) Postpaid billing and collection records;
      13. m.) GCash balance and transactional records;
      14. n.) Borrower status;
      15. o.) Monthly purchase data;
      16. p.) Payment and collection records; and
      17. q.) Other relevant information that may be deemed necessary
    • 7.2. You further authorize and consent to Fuse Group to share any and all of your personal information enumerated in the preceding paragraph to its contracted third-parties to perform any of the above purposes.
    • 7.3. You agree that Fuse Group may further disclose your information in compliance with the lawful orders of governmental agencies and existing laws, rules, and regulations, or to the extent that is necessary or incidental to Fuse’s business operations, plans, and its legal and contractual obligations.
    • 7.4. You authorize Fuse Group to process personal data of your emergency contact or any individual whose personal data you may share with the Fuse Group in connection with any product or services that you may subsequently avail after GLoan application. You also warrant that the consent of such individuals for processing described in the Agreement is obtained.
    • 7.5. You authorize the Fuse Group to retain all information and documents that you submitted and use such information and documents for Fuse’s legitimate business purposes, such as (a) processing of any application or request, collection of repayments, and account closure in connection with any product and/or service offered by Fuse Group, (b) to improve Fuse Group’s existing products and services, and (c) advertising and promoting new products and services.
    • 7.6. You acknowledge that Fuse is committed to continuously improving its products and services and pursuing its business plans. To achieve these and to be able to perform its legal and contractual obligations, you agree and consent that Fuse may disclose and make available to the Fuse Group, on a confidential basis, any information that you have provided to Fuse and may hereafter provide, and other information Fuse may have, directly or indirectly, gathered and may subsequently gather through its verification and validation and/or through other methods and means.
    • 7.7. You understand that as a data subject, you have the right to suspend, withdraw, or request the blocking, removal, or destruction of your personal information within the processing systems of Fuse upon discovery and substantial proof that your personal information is no longer necessary for the purpose for which it was collected or provided. Fuse shall mark your account in its database as inactive or deactivated and retain the personal information only to comply with the retention requirements of applicable laws.
    • 7.8. Fuse may require you to update your personal information as needed. The personal information that you may update includes current and permanent addresses, mobile numbers, landline numbers, and email addresses. Fuse shall send all communication about the Loan to the most updated contact details that you provided to Fuse.
    • 7.9. You, as the data subject, have the right to seek indemnity for damages sustained, if any, due to inaccurate, false, unlawfully obtained, or unauthorized use of personal information.

  • 8.CUSTOMER PROTECT PROGRAM

    • 8.1. All transactions made within the GCash App relating to your GLoan, including loan application, availment, and repayment, are covered by GCash’s Customer Protect Program. The Customer Protect Program will cover unauthorized transactions originating from the GCash App.
    • 8.2. You must report unauthorized transactions within fifteen (15) days from the transaction date. GCash and Fuse reserves the right to decline cases that have been reported beyond the said fifteen (15) day period.
    • 8.3. For stolen phones, you must have reported the same and requested to block your GCash or GLoan account within twenty-four (24) hours. GCash and Fuse shall process the suspension of the GCash or GLoan Account only upon proper authentication of the loss. All transactions made before you reported the loss of your phone and the authentication of the same shall remain your responsibility.
    • 8.4. Giving away your MPIN, OTP, and other information necessary to access your account is considered an unauthorized transaction, which the Customer Protect Program does not cover. In such a case, you shall assume full accountability for your loan accounts inside the GCash App, which includes loan application, availment, and repayment.
    • 8.5. GCash and Fuse will not compensate you if you avail of a GCash loan product while your account is compromised. Accordingly, you shall pay all dues, including interests, penalties, and fees relating to the availed loan product.
    • 8.6.

  • 9.

  • 10.MISCELLANEOUS

    • 10.1. If Fuse requires the services of counsel or a third-party service provider to enforce any of its rights and remedies under the Agreement, Fuse shall be entitled to recover from you attorneys’ fees, service provider’s fees, and to the extent permitted by law, fines, penalties, if any.
    • 10.2. The Agreement will be legally binding and will benefit you, Fuse, and your respective successors and assigns.
    • 10.3. Fuse shall have the unrestricted right to sell, transfer, or assign, at any time or from time to time, to the extent allowed by applicable laws, any or all of its rights or obligations under the Agreement, to any member of the Fuse Group, or any person or entity, without your prior consent. Such sale, transfer, or assignment shall bind you to fulfill or perform all your obligations under the Agreement to the transferee or assignor, including the payment of installments.
    • 10.4. You shall not assign or transfer any or all of your rights and obligations under the Agreement without Fuse’s prior written consent.
    • 10.5. You acknowledge and agree to maintain an active GCash account for the duration of the loan term. Fuse reserves the right to transfer your loan account to another GCash account matching your KYC details should you enroll using another mobile number. Failure to maintain an active GCash account may be considered a breach of this agreement.
    • 10.6. If any provision of the Agreement is declared invalid, the other provisions shall remain valid and effective to the extent permitted by applicable laws.
    • 10.7. The laws of the Republic of the Philippines shall govern the Agreement.
    • 10.8. Any dispute arising from the Agreement shall be brought before the proper courts of Taguig City to the exclusion of all other courts except for small claims cases.
    • 10.9.

      The Agreement shall be effective from the date you submit your GLoan application.

    • 10.10.
      You also authorize and consent to the Fuse Group to offer you products and services related to GLoan or otherwise, through mail, email, SMS, telephone, or by any other means of communication, including social media.
